- Non-Refundable Payments: Payments are non-refundable. Services commence immediately upon payment, with efforts to deliver products and/or services promptly.
- Scope Adjustments: Adjustments beyond the original scope may incur additional charges at a standard rate of $280.00 per hour, billed in fifteen-minute increments.
- Cancellation Policy A 30-day written notice is required for the cancellation of any recurring services, such as advertising, marketing, technology, hosting, licensing, or support services.
- Intellectual Property and Rights Reservation: The Customer is prohibited from unauthorized selling, renting, leasing, sublicensing, distributing, transferring, copying, reproducing, displaying, modifying, or timesharing any work product provided by the Company. The Company retains all copyright and ownership rights until full payment is received.
- Late Payments and Remedies: Late payments may result in service suspension, late fees, interest charges, and the recovery of costs associated with collecting delinquent invoices, including reasonable attorney’s fees and court costs.

Recurring Services: Marketing and Hosting Solutions
Our suite of marketing and hosting solutions is designed to provide continuous, cumulative value over time. These services, critical for maintaining and enhancing your online presence, are structured as recurring, often spanning multiple consecutive months. This model is pivotal for delivering consistent, impactful results through services such as content marketing, SEO, PPC advertising, social media management, and more.
Billing and Payment Terms for Recurring Services:
- Non-Refundable Payments:Payments for all digital marketing services are non-refundable. We commit resources and incur hard costs at the start of each billing cycle to fulfill these services, making refunds infeasible.
- Pre-Paid Subscriptions:All digital/internet/online marketing solutions are billed as pre-paid monthly recurring subscriptions. Payments for each month's services are due in advance, ensuring continuous service delivery without interruption.
- Cancellation Policy: While we strive for flexibility, a 30-day written notice is required to cancel any recurring services. This notice period allows us to adjust our resource allocation and ensure a smooth transition. In the absence of proper cancellation notice, a cancellation fee will be assessed. The initial month's payment signifies your agreement to these terms.
- Service Suspension for Unpaid Invoices: To maintain the integrity of our services and operations, an account will be suspended if an invoice remains unpaid 14 days past the due date. Delinquent accounts are subject to collections after 30 days of non-payment.
Hosting Services
Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. Software and Website Development Projects
Understanding Project Pricing and Payment:
- Our projects are not fixed-price. We provide an estimated total development time based on our best assessment. Should the project exceed these estimates, additional charges will apply at our standard hourly rate of $280.00.
- Payments are due upon invoice issuance. Deposits to commence projects are non-refundable, and full payment is required without exception. Should a project be canceled or postponed, all payments made remain with the company, and the full invoice balance is due.
Intellectual Property and Ownership:
- RocketCrew.ai retains copyright to all proprietary intellectual property developed during the project, including software source code, website code, and design elements until full payment is received.
- Upon full payment, ownership of the final product is transferred to the client, subject to third-party licenses for any technology or code used in the project's development.
Project Development and Client Collaboration:
- The nature of software and website development involves intricate details and potential evolutions. As such, our initial time and cost estimates are made in good faith but are not guaranteed.
- Should the project scope change or additional time be needed, we will notify the client for approval before proceeding. Unapproved additional time may result in project suspension.
- We emphasize open communication and collaboration with our clients to ensure project success. It is crucial for clients to understand that non-approval of necessary project adjustments may affect the completion and delivery.
- Clients are responsible for providing timely feedback, approvals, and any necessary content to facilitate project progress. Delays or changes initiated by the client may affect project timelines and costs.
Hosting and Migration:
- Clients have the option for RocketCrew.ai to host their website post-development or to select their hosting provider. A migration fee of approximately $500 may apply for transferring the site to a third-party host.
Consulting, Research, Analysis, Setup, and Digital Advertising Services
Consulting Services:
- Consulting service fees are non-refundable, reflecting the significant strategic value and expertise provided. Our consultations aim to deliver insights, strategies, and actionable plans tailored to your business needs.
Research, Analysis, and Setup Services:
- These services necessitate an upfront full payment before the commencement of any services or release of work products. Given the preparatory nature and the resources allocated to these tasks, payments made towards setup, research, analysis, marketing setup, and related service fees are non-refundable.
PPC and Digital Advertising: While we specialize in comprehensive digital marketing strategies, traditional PPC management is not our primary focus. Clients interested in PPC are encouraged to consult with recommended providers. Our advertising strategies are designed for holistic digital presence enhancement.
Digital Advertising (Excluding Traditional PPC):
- Our digital advertising strategy encompasses a comprehensive approach including content design, graphics, copywriting, development of funnels, complimentary PR, SEO, and more, to ensure a cohesive and effective campaign.
- We do not manage traditional Pay-Per-Click (PPC) ad budgets directly. Our focus is on broader and more integrated digital marketing strategies. For clients specifically interested in traditional PPC campaigns, we can provide recommendations for reputable PPC providers. Our PPC Campaign Strategy Packages are offered on a limited basis, focusing on integrating PPC within a wider marketing strategy rather than standalone PPC management.
These sections aim to clarify the scope of services offered, emphasizing the non-refundable nature of fees for consulting, research, analysis, and setup due to the immediate allocation of resources and expertise these services entail. Additionally, it distinguishes our digital advertising services from traditional PPC management, underscoring our comprehensive approach to digital marketing strategies.
Credit Card Authorization and Disputes
For billing concerns, we urge direct communication with our team to seek resolutions. In the case of disputes, clients are advised to contact us before initiating chargebacks. Chargeback disputes will incur a $250 processing fee plus any outstanding balances.
By engaging with RocketCrew.ai (operated by Rocketocity LLC, doing business as Rocket Crew and WaterMitigation.ai), you grant us the authority to process all charges related to our services and products to the credit card you've provided, in accordance with your cardholder agreement. It is understood that refunds are not issued under any circumstances as per our established terms and policies.
Furthermore, you irrevocably consent to instruct your card issuer to reject any chargeback requests associated with this authorization, at any time and for any reason. This encompasses any form of agreement confirmation, including fax, digital, or electronic transmissions, which are considered legally binding acknowledgments of these terms as outlined in related invoices.
In situations where a chargeback is filed or a payment is declined post-transaction — whether for services accessed online, via email, or through direct phone orders — we reserve the right to immediately remove any digital products or services provided from the internet and halt ongoing projects. In the event of a chargeback or decline while in possession of any of our work, we may initiate legal actions to prevent unauthorized use of our products or services. All materials must be returned immediately and cannot be used until the dispute is resolved and compensation for services rendered is fully paid.
Should a decline, chargeback, or payment dispute arise from a credit card company or bank, the implicated service or project will be suspended immediately. A processing fee of $250.00, alongside any outstanding balances accrued due to the chargeback(s), will be required to resume services or release further work.
We urge our clients to reach out to us directly with any billing concerns or questions, emphasizing that initiating a chargeback or PayPal dispute for a valid charge is considered fraudulent and is not an acceptable method for seeking a refund. Familiarizing yourself with our billing, payment terms, and refund policy before making a payment is highly recommended.
In the event of arbitration or legal proceedings triggered by a dispute under this agreement, the prevailing party is entitled to recover reasonable attorney’s fees. These terms are governed by the laws of the state of Washington, with both parties consenting to the exclusive jurisdiction and venue of Clark County, Washington courts for any legal matters.

- Improvements and Derivatives: Any enhancements, improvements, or derivative works arising from our services or deliverables become the sole property of the Company. As our client, you agree to assign—and ensure your employees and contractors assign—any rights in such materials to the Company.

- Limited Rights: Customers are granted a limited, non-exclusive right to use the deliverables provided as part of our services. This includes, but is not limited to, warranties of merchantability, non-infringement, fitness for a particular purpose, and any warranties arising out of course of dealing or usage of trade.
- Customer Acknowledgment: You acknowledge that the Contractor does not guarantee that the services and deliverables will be uninterrupted, error-free, or completely secure. You are responsible for determining the suitability of the services for your needs and assume all risks associated with their use, including risks associated with incorrect data, or defects in the services provided.
- Jurisdictional Variations: Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
Scope of Liability: The Contractor's total liability under these Terms and Conditions, and any supplementary agreements, for any claim related to our products or services is limited to the amount you paid for the services or products causing the claim.
Exclusion of Damages: : Under no circumstances will the Contractor, or its affiliates, employees, or agents be liable for any indirect, special, incidental, consequential, or punitive damages of any kind, including lost profits or revenue, business interruption, or loss of data, arising out of or in connection with these Terms and Conditions or the services provided, regardless of the cause of action or the theory of liability, even if advised of the possibility of such damages.

This license allows for the use of the software under our hosting services, without transferring ownership. All software licenses are non-refundable and, after one year, non-transferable to a new domain.

While we strive for compatibility and performance, we are not liable for any malfunctions or incompatibilities arising from third-party software. You are responsible for complying with the licenses of third-party software used in conjunction with our services. Confidential Information encompasses a broad range of business and technical data that the Company considers proprietary and confidential. This includes, without limitation, all forms of communication, customer information, software technology and systems, design details, financial data, trade secrets, strategic plans, marketing strategies, research data, and any other non-public information concerning the Company's business operations, disclosed in any format.

- Communications and Customer Data: Includes all verbal and non-verbal interactions and information related to our clients and their projects.
- Technical and Business Data: Encompasses software code (both source and object), system designs, user interfaces, databases, financials, and strategic business plans.
- Intellectual Property: Covers algorithms, processing techniques, product samples, development plans, pricing strategies, and internal reports.
- Marketing and Strategy Information: Comprises SEO tactics, market research findings, niche marketing plans, and unpublished business strategies.
Restriction on DisclosureThe Customer is expressly prohibited from disclosing any of the Company’s Confidential Information to third parties, including but not limited to posting on public forums or review websites. Any disclosure is considered a breach of these Terms and Conditions.
Acknowledgment of Confidentiality: By making a payment, the Customer acknowledges and agrees to these confidentiality obligations. This includes a commitment to safeguard the Confidential Information received during the course of business engagements with the Company.
Consequences of Breach: A breach of confidentiality obligations may result in irreparable harm to the Company. In such events, the Company reserves the right to seek injunctive relief and any other remedies available under law to prevent and limit damage.
Dispute Resolution Process:
Should disputes arise, we strongly advocate for mediation or arbitration as a first recourse before litigation. This approach allows for a cost-effective and amicable resolution. Disputes will be resolved by an independent mediator or arbitrator, agreed upon by both parties, with proceedings to be held in accordance with the rules of the American Arbitration Association.
